How to File a DMCA Takedown Notice

To submit a valid copyright infringement notice under 17 U.S.C. § 512(c)(3), your written notification must include all of the following:

  • A physical or electronic signature of the person authorised to act on behalf of the owner of the allegedly infringed copyright.
  • Identification of the copyrighted work or works you claim have been infringed. If multiple works are covered by a single notification, a representative list is acceptable.
  • Identification of the material on our website that you claim is infringing, with enough detail for us to locate it — for example, a direct URL to the specific page or product listing.
  • Your contact information, including your full name, mailing address, telephone number, and email address.
  • A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or are authorised to act on their behalf.

Our Response to Valid Notices

Upon receiving a complete and valid DMCA notice, we will act expeditiously to remove or disable access to the allegedly infringing content. We will also notify the user who posted the content, where applicable, that the material has been removed.

We reserve the right to terminate the accounts of users who are found to be repeat infringers, in accordance with our obligations under 17 U.S.C. § 512(i).

Counter-Notification Process

If you believe that material you posted was removed as a result of a mistake or misidentification, you may submit a counter-notification under 17 U.S.C. § 512(g). A valid counter-notification must include:

  • Your physical or electronic signature.
  • Identification of the material that has been removed and the location where it appeared before removal.
  • A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  • Your full name, mailing address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which Soft Pajama may be found), and that you will accept service of process from the person who submitted the original DMCA notice.

Send your counter-notification to the same DMCA agent contact details listed above. Upon receipt of a valid counter-notification, we will forward it to the original complainant and may restore the removed content within 10–14 business days, unless the copyright owner first files an action seeking a court order to keep the material down.

Warning Against False Claims

Please be aware that submitting a DMCA notice or counter-notification containing materially false or misleading information may expose you to significant civil liability under 17 U.S.C. § 512(f), including damages, attorneys' fees, and costs incurred by the affected party. We take false claims seriously and will act accordingly.
